This simple option will save the homeowner a lot of money in court costs and additional interest on the home loan. However, turning the home over to the bank is a process that must be negotiated. The bank has to accept your offer, and they are under no obligation to do so. The bank is more likely to accept the home back from you if you have had a true hardship that has affected your ability to make payments on your Spanish mortgage. Any homeowners that can prove such a hardship to the bank will be even more likely to succeed in negotiating a turnover.

If despite your attempts to negotiate a home turnover, the bank refuses your offer, you must then sell your home. The homeowner must sell the home for as much as possible, as the bank that holds the Spanish mortgage will come after him or her for any amount remaining on the loan after the home sale proceeds are paid to the bank. They are more likely to do so if the shortfall is large. However, the bank can legally pursue the homeowner for any shortfall amount at all. The bank may collect money by placing liens on any and all assets of the homeowner..

Defaulting on a Spanish mortgage is an extremely serious situation, so it is essential that the homeowner work as closely as possible with the bank as soon as it is evident that defaulting is going to be unavoidable. Doing so can result in an agreement that will satisfy the bank, relieve you of your responsibilities associated with the Spanish mortgage, and allow you to keep other assets you may own.

There are two different categories in the Spanish legal processes for the purchase of property. The first legal document is the preliminary contract, known as Contrato privado de compraventa, and the second is the completion contract, known as Escritura de compraventa.


A preliminary individual sale bill should be signed after both sides agree to the cost. Before the Contrato privado de compraventa is signed, the vendor must show proof of ownership, and also proof that there are no liens or judgements against the property. Debts are charged to the property themselves in Spain, and any outstanding mortgage amount would then be passed on to the purchaser. The completion date, overall price, and property description will all be elaborated in the preliminary sales contract. Expect to pay a deposit that ranges between 5 and 15 percent of the purchase price. This money is held for you in a secure customer account. A person would theoretically be able to sign the initial sales contract without a deposit, but it isn’t necessarily a good idea.


The second stage is the final contract stage, or the Escritura de compraventa stage. The customer will need to pay all fees and the price of the product on the date of completion. The vendor and the purchaser will then come together to sign the contract, which is equivalent to a deed on the property. In front of a Notary Public the buyer will receive the deed of conveyance which is known as escritura in Spain. A photocopy of the deed will be provided to the tax official and property registrat to ensure everything is legitimate. In Spain, all deeds of sale must be witnessed by a Notary Public, which is a public official in that country. However, you need to have your own legal counsel to protect your own interests during the transaction. Remember too that as the buyer you will be responsible for paying the Notary Public’s charges along with the real estate sales taxes.

The first thing you have to do to stop a roof from leaking is find the leak. This duty is not always the easiest thing to do. Some leaks are easy to find while others may be far away from the stain on your ceiling. Roof leak repair is not as easy as some people may think. There are many ways that a roof leak can be caused. Not enough of maintenance one cause. If you think you have a leak in your roof, check it out and then trace the source back as soon as possible. This will cause you least amount of time and money. Some roof leaks are caused because of missing or damaged shingles. Shingles are very easy to replace. Some of the tools you will need are a pry bar, scrapper, new shingle, utility knife, roofing nails, hammer, roof cement, and a trowel. First carefully remove the nails with the pry bar. Then slide out the old shingle, scrap off any leftover cement. Slide the new shingle in and line it up with all the other remaining shingles. Use a roofing nail in each corner and cover with roofing cement. On a flat roof, leaks sometimes occur in the low areas or when the felt has been ruined. Roof leak repair can be done on the felt of a flat roof. You will need a utility knife, clean rags, asphalt roof cement, nails and a hammer. Look for a blister in the felt. Make a small cut in the blister, but not down to the good felt underneath. If there is any water in the blister press it out nicely and use a towel to dry the area. Use a big amount of roofing cement and firmly press down both sides of the felt. Close the blister for good with a row of nails along each side of the cut. Then use the roofing cement over the entire area.

Unfortunately for many, they forget about the other realities: location and travel time, upkeep and the associated costs, high property taxes, their children’s school and other home activities, guests. All of these put stress on the new Vacation Home owner, and how they prepare ahead of time to address these issues determines how enjoyable their new purchase will be.

The first item to consider when purchasing a Vacation Home is location. Is it near enough from your main home such that you can enjoy it regularly enough? If not, consider another investment. The last thing you want to do is make a huge investment in property that you can not regularly enjoy. Though real estate has always been considered a good investment it is not considered liquid, and expensive vacation homes can take a long time to sell.

Cost of upkeep and property taxes should also be heavily considered. Maintaining a vacation home is not cheap and the local town officials love to hit the vacation homes hard with property tax bills.

One also needs to consider his or her own weekend responsibilities and those of their children.
